Terms and Conditions of Sale of Interior
These terms and conditions apply to all contracts made by the customer with VanWurks Limited. Registered address Unit D, 104 Shaw Road, Oldham, OL1 4AB. Telephone number: 0161 637 4882. Email address: email@example.com. Company Registration Number: 06700288. VAT Registration Number: 939 9236 70. Any amendments or departure from these terms and conditions shall be invalid unless previously agreed in writing by an Authorised Representative. The provisions in these terms and conditions do not affect the statutory rights of a consumer.
2.1 The following definitions shall apply to these terms and conditions and to any additional contract terms incorporating them.
(i) “Authorised Representative” means Director or Company Secretary.
(ii) “Contract” means any valid legally binding contract between the Customer and VanWurks Ltd.
(iii) “Customer” means any person, company or firm VanWurks Ltd supplies goods to.
(iv) “Goods” means the products and services which VanWurks Ltd agreed to supply to the Customer.
- Ordering an Interior
3.1 We require a £250 deposit to secure an order for an interior which is to be installed by someone other than VanWurks Ltd. If you are placing an order for an install by VanWurks Ltd, we require a £500 deposit.
3.2 This deposit is non-refundable.
3.3 The deposit can be made by either bank transfer, card (please note there is a charge for credit cards) or cash.
3.4 Any bank charges for receiving international payments must be met by the customer. For payments of £100 and under, the bank charges are £1. For payments over £100 the bank charges are £7.
3.5 We aim to dispatch all orders within four weeks however this time can increase during busy periods. We will inform you of likely durations at the time of placing the order.
3.6 Payment must be received in full (with funds cleared) prior to dispatch of an order.
3.7 If payment is being made by card, the goods have to be delivered to the address where the card is registered.
3.8 All goods remain the property of VanWurks Ltd until payment has been received.
3.9 If VanWurks Ltd are carrying out the installation, your vehicle must be mechanically and electrically safe, running and watertight.
3.10 Unless previously agreed with an Authorised Representative, your order must be delivered or collected within 14 days of VanWurks notifying you that your order is complete. After 14 days, you may be subject to a storage charge.
4.1 All prices are in sterling pounds (£).
4.2 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
4.3 Whilst we make every endeavour to adhere to our published prices, we reserve the right to amend them to those current at the date of dispatch.
4.4 Special promotional offers cannot be combined with other offers or sale items.
4.5 Our prices are reviewed periodically and the next review will be on 01/04/2019.
5.1 Delivery costs will depend on the size (volumetric weight) of your order and where the order is to be delivered to
5.2 If payment has been made by card, the place of delivery of the goods must be the address of where the card is registered.
5.3 Any date or period quoted by VanWurks Ltd for despatch is given in good faith by way of estimate only. Once dispatched, the on time delivery of a pallet is the responsibility of the relevant courier company and VanWurks Ltd cannot be held responsible for a package not reaching its destination on time.
5.4 The delivery driver will not be able to carry the goods up or down steps, carry the goods through a property, wheel the pallet across a gravel driveway or up particularly steep driveways. Unfortunately the delivery company will be unable to remove items from the pallet or take the pallet away with them.
6.1 The Customer is under a duty to inspect the goods on delivery or on collection as the case may be.
6.2 In circumstances where VanWurks Ltd undertakes delivery of the goods, claims for damage in transit or shortage in delivery of the goods will only be considered if the carriers and VanWurks Ltd receive written notification of such damage within three working days of delivery or in the event of loss of goods in transit within 14 working days of the date of consignment. The notification must include the invoice number, delivery note number and details of the claim. Any obvious damage to the packaging of the goods must be noted on the delivery note when accepting the delivery. When the goods are accepted from carriers without being checked the delivery book must be signed “Not Examined”.
6.3 In all cases where defects or shortages are complained of, VanWurks Ltd shall be under no liability in respect thereof unless an opportunity to inspect the goods is afforded to VanWurks Ltd before any use is made thereof or any alteration or modification is made thereto by the Customer.
6.4 Subject to clauses 6.2 and 6.3, VanWurks Ltd shall make good any shortage in the goods and where appropriate will replace any goods damaged in transmit as soon as it is reasonably able to do so, but otherwise shall be under no liability whatsoever or however arising from such shortage or damage.
- DIY Installation
7.1 Any guarantee is valid only if the products are installed in accordance with the installation instructions provided by VanWurks Ltd.
